The Mumbai court denied anticipatory bail to two men who were booked under Sections 354 (outraging modesty of a woman), 354A (sexual harassment), 354D (stalking) and 509 (word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code (IPC).
The two men were sales managers of a real estate company who allegedly told two of their female colleagues that they have a beautiful figure and repeatedly asked them out. “Madam, aapne khudko bahut maintain rakha hai, aapka figure bahut achcha hai. Kya aap mere saath bahar jaane ke baare mai kuch socha ki nahi? (Madam, you have maintained yourself so well, your figure is very beautiful. Have you thought about going out with me?)
The Sessions Court Judge, AZ Khan, opined that the allegations of outraging modesty and using filthy language towards women are serious. Thus the court refused to grant relief to the two individuals, as custodial interrogation of the accused is necessary. It was also observed that there was prima facie evidence against the accused.
