The Allahabad High Court has recently observed a woman can’t be ousted from her matrimonial house on the basis of the summary proceedings under the Senior Citizens Act, 2007. The decision was ruled in favour of a petitioner named Khushboo Shukla who had filed a petition in the High Court to challenge the order of the SDM (Sardar) Lucknow which was passed earlier this year. The SDM had ordered Shukla to vacate her matrimonial house based on a petition that was filed by her father-in-law.
Shukla moved to the High Court challenging the SDM’s order that rendered her and her child homeless after the death of her husband.
The Lucknow bench of the Allahabad High Court came to her aid and quashed the eviction order. A single-judge bench of Justice Vivek Chaudhary directed Shukla’s in-laws to pass the possession of the ground floor of the house to her. “Petitioner shall not in any manner interfere with the ingress and egress of the occupants of the floors above the ground floor. Private respondents (in-laws) also shall not disturb or interfere in any manner with the living of the petitioner and her son in the said property,” ruled the court.
